TERMS AND CONDITIONS OF SALE

ARTICLE 1 – SCOPE

These Terms and Conditions of Sale apply to all sales concluded between KESARIYA COLLECTIVE, hereinafter referred to as the “Seller”, and any non-professional buyer, hereinafter referred to as the “Customer”, purchasing products through the website https://kesariyacollective.com.

The products offered include clothing, fashion accessories, leather goods, costume jewellery and lifestyle products from selected brands.

The main characteristics, photographs, sizing information and descriptions of the products are presented on the website. Customers are responsible for reviewing this information before placing an order.

Product offers are valid while displayed on the website and subject to availability.

These Terms are accessible at any time on kesariyacollective.com. By confirming an order, the Customer acknowledges having read and accepted them.

Products are available for delivery to the destinations displayed during checkout.

For orders delivered outside France, the Customer may be considered the importer of the products and may be responsible for customs duties, import taxes and other local charges.

ARTICLE 2 – PRICES

Products are supplied at the prices displayed on kesariyacollective.com when the order is placed.

Prices are expressed in euros.

VAT not applicable pursuant to Article 293 B of the French General Tax Code.

Any discounts or promotional offers are applied under the conditions displayed on the website.

Prices do not include delivery charges unless expressly stated. Delivery charges are calculated and displayed before the Customer confirms the order.

The total amount payable, including any applicable delivery charges, is shown before payment.

The Seller may change prices at any time. However, products will be charged at the price displayed when the order is confirmed.

ARTICLE 3 – ORDERS

The Customer selects the products they wish to purchase and adds them to their basket.

Before confirming the order, the Customer can review and amend the selected products, quantities, delivery address and other information.

The Customer must provide accurate and complete information when placing the order.

The sale becomes final after:

  • the Customer has reviewed the order;

  • the Customer has accepted these Terms and Conditions;

  • the Customer has expressly confirmed the payment obligation;

  • payment has been successfully authorised.

An order confirmation is sent to the email address provided by the Customer.

The Seller reserves the right to refuse or cancel an order in the event of payment failure, suspected fraud, an obvious pricing error, product unavailability or an unresolved dispute concerning a previous order.

If an order is cancelled by the Seller after payment, the amount paid will be refunded using the original payment method.

ARTICLE 4 – CANCELLATION BEFORE DISPATCH

Customers may request the cancellation of an order by contacting hello@kesariyacollective.com as soon as possible.

An order may only be cancelled if it has not yet been dispatched.

Once an order has been dispatched, it can no longer be cancelled. The Customer must wait to receive the order and may then exercise the statutory right of withdrawal, subject to the conditions set out in Article 8 and the Return and Refund Policy.

If a cancellation request is accepted before dispatch, the amount paid will be refunded to the original payment method.

Submitting a cancellation request does not guarantee that the order can be stopped. If the parcel has already been dispatched, the standard withdrawal and return procedure will apply.

ARTICLE 5 – PAYMENT

Payment must be made in full when the order is placed.

Available payment methods are displayed during checkout and may include debit or credit cards and other payment methods supported by Shopify Payments.

Payment information is securely processed by the payment provider. KESARIYA COLLECTIVE does not directly store the Customer’s complete payment card details.

The Seller is not required to dispatch the products until full payment has been successfully received.

ARTICLE 6 – DELIVERY

Products are delivered to the address provided by the Customer during checkout.

Available delivery destinations, processing times, estimated delivery times and delivery charges are displayed during checkout or explained in the Shipping Policy.

Delivery times are estimates unless a specific delivery date has been expressly agreed.

The Customer is responsible for providing a complete and accurate delivery address. The Seller cannot be held responsible for a delay or failed delivery resulting from incorrect or incomplete information supplied by the Customer.

If delivery is significantly delayed, the Customer may contact the Seller at hello@kesariyacollective.com and exercise any rights available under applicable consumer law.

Delivery is completed when the Customer, or a person designated by the Customer other than the carrier, physically receives the products.

The Customer should inspect the parcel upon delivery. If a product is damaged, incorrect or missing, the Customer should contact hello@kesariyacollective.com as soon as possible and provide the order number and, where possible, photographs.

ARTICLE 7 – TRANSFER OF OWNERSHIP AND RISK

The Seller remains the owner of the products until full payment has been received.

The risk of loss or damage passes to the Customer when the Customer, or a person designated by the Customer other than the carrier, physically receives the products.

If the Customer independently appoints a carrier who was not offered by the Seller, the risk passes when the products are handed over to that carrier.

ARTICLE 8 – RIGHT OF WITHDRAWAL

Customers located in the European Union generally have 14 days from receipt of their order to withdraw from the purchase without providing a reason.

To exercise this right, the Customer must send a clear statement expressing the decision to withdraw before the 14-day period expires.

The request may be sent by email to hello@kesariyacollective.com or by using the withdrawal form provided at the end of these Terms.

After notifying the Seller, the Customer must return the products without undue delay and no later than 14 days after communicating the decision to withdraw.

Before returning a product, the Customer should contact hello@kesariyacollective.com to receive the applicable return instructions and return address.

Returned products should be complete and in the same general condition in which they were received, with their original tags and packaging where reasonably possible.

The Customer may inspect or try on a product only to the extent reasonably necessary to establish its nature, characteristics and fit. The Customer may be responsible for any loss in value caused by handling beyond what is reasonably necessary.

Unless otherwise stated, return shipping costs are the Customer’s responsibility. We recommend using a tracked shipping service.

The Seller may withhold reimbursement until the returned products have been received or the Customer has provided evidence that they have been sent back, whichever occurs first.

Approved refunds will be issued using the original payment method. Where required by law, the original standard delivery charge will also be reimbursed.

Additional costs resulting from the Customer choosing a more expensive delivery method will not be refunded.

The refund will be processed within the period required by applicable consumer law.

The right of withdrawal may not apply to:

  • personalised or made-to-order products;

  • products that deteriorate or expire rapidly;

  • sealed products that cannot be returned for health or hygiene reasons after being unsealed;

  • other products legally excluded from the right of withdrawal.

Any applicable exception will be clearly indicated on the relevant product page before purchase.

ARTICLE 9 – STATUTORY GUARANTEES AND SELLER’S LIABILITY

Products supplied by the Seller benefit from the French statutory guarantee of conformity and the statutory guarantee against hidden defects.

Under Articles L.217-3 and following of the French Consumer Code, the Seller is responsible for defects in conformity that exist when the product is delivered and that become apparent within the applicable statutory period.

Where a product is not in conformity, the Customer may request repair or replacement under the conditions provided by law.

If these remedies are impossible, disproportionate or not completed within the legally required period, the Customer may be entitled to a price reduction or cancellation of the sale.

Under Articles 1641 and following of the French Civil Code, the Seller is responsible for hidden defects that make a product unsuitable for its intended use or reduce its usefulness to such an extent that the Customer would not have purchased it, or would have paid a lower price, if they had known about the defect.

A claim based on a hidden defect must be brought within two years of discovering the defect.

To exercise these rights, the Customer must contact the Seller in writing at hello@kesariyacollective.com.

Where a product is confirmed to be defective, damaged, incorrect or non-conforming, the Seller will provide an appropriate remedy in accordance with applicable law. Eligible return costs will not be charged to the Customer.

The Seller cannot be held responsible for damage caused by misuse, negligence, improper care, normal wear and tear, an accident or circumstances beyond its reasonable control.

Nothing in these Terms excludes or limits any statutory consumer right or liability that cannot legally be excluded or limited.

ARTICLE 10 – PERSONAL DATA

Personal data collected through the website is used to process payments, manage orders, arrange delivery, provide customer service, prevent fraud and comply with legal obligations.

Personal data may be shared with service providers where necessary to process an order, including payment and delivery providers.

ARTICLE 11 – INTELLECTUAL PROPERTY

The content of kesariyacollective.com, including its text, photographs, images, graphics, logos and visual elements, is protected by intellectual property laws.

This content belongs to KESARIYA COLLECTIVE, its partner brands or the relevant rights holders.

Any unauthorised reproduction, distribution, modification or commercial use of all or part of the website is prohibited.

ARTICLE 12 – GOVERNING LAW AND LANGUAGE

These Terms and all transactions arising from them are governed by French law.

Customers residing in another country retain any mandatory consumer protection granted by the laws of their country of residence.

These Terms are written in English. If a French version is also published, the Seller must clearly identify which version will prevail in the event of a difference in interpretation.

ARTICLE 13 – COMPLAINTS, MEDIATION AND DISPUTES

The Customer should first submit any complaint directly to the Seller in writing.

If the dispute cannot be resolved directly, the Customer may refer the matter free of charge to the consumer mediator appointed by KESARIYA COLLECTIVE:

The parties should attempt to resolve any dispute amicably before starting legal proceedings.

If no amicable solution is reached, the Customer may bring proceedings before any court having jurisdiction under applicable consumer law.

WITHDRAWAL FORM

If your order has not yet been dispatched and you wish to cancel it, please contact hello@kesariyacollective.com as soon as possible. Cancellation is only possible before dispatch.

If your order has already been dispatched or received, you may use the form below to exercise your statutory right of withdrawal, subject to the eligibility conditions and 14-day period stated in Article 8 and the Return and Refund Policy.
